לאחרונה עלו בפני בית המשפט העליון סוגיות עקרוניות הנוגעות לפרוצדורה בהליכי הסגרה ובמסגרתן נבחנו זכויותיו השונות של מבוקש ההסגרה במסגרת הליך זה.
במאמר זה נסקור בקצרה יחסית את הסוגיות שהועמדו לעיון בית המשפט העליון והכרעתן:
תרגום בקשת הסגרה
האם קמה למדינה חובת תרגום של בקשת הסגרה שהוגשה כנגד מבוקש? כדי לענות על שאלה זו התבסס בית המשפט העליון על סעיף 10 באמנת ההסגרה עם ארצות הברית ולפיו:
” הבקשה וכל המסמכים האחרים שמגיש הצד המבקש יתורגמו לשפת הצד המתבקש, אלא אם כן הוסכם אחרת” (פרוטוקול הסכם הסגרה בין מדינת ישראל לממשלת ארצות הברית המתקן את אמנת ההסגרה שנחתמה בוושינגטון ביום ה-10 בדצמבר 1962).
כבר בעבר הוכרע כי קיים צורך וחובה לתרגם בקשות הסגרה במקרה שאין השפה שגורה בפיו של המבוקש כשחובה זו נגזרת מתוך עקרונות המשפט הפלילי הרואים בנאשם את מרכזו של ההליך הפלילי תוך שישנה דרישה שלא יועמדו חומות ומחסומים בפני הנאשם בבואו להתגונן בפני האישומים שהושתו כנגדו ובמיוחד לאור הפגיעה שמתקיימת בהליך הסגרה בסעיף 5 לחוק יסוד כבוד האדם וחירותו.
נחיצות התרגום
למרות עקרונות המשפט הפלילי שהוצגו לעיל הרי שבהליך ההסגרה יש חובה כללית לבחון כל מקרה בהתאם לנסיבותיו היחודיות תוך שבית המשפט נדרש לבחון את הצורך בתרגום ונחיצותו למבוקש ההסגרה ותוך שימת לב להתמשכות הליך ההסגרה כתוצאה מהזמן הנדרש להכנת התרגום או במילים אחרות בית המשפט צריך לבדוק האם מבוקש ההסגרה מבקש להיאחז בצורך לתרגם את בקשת ההסגרה כדי לנצל את הימשכות ההליכים ולדחות ככל שאפשר את הליכי ההסגרה או מסיבות אחרות שרלוונטיות להליך העיקרי.
כשמדובר במבוקש הסגרה ששפת הבקשה המקורית שגורה בפיו באופן מלא הרי שבית המשפט לא ידחה את ההליכים כדי להמתין לתרגום הבקשה וזאת גם מכיוון שהדיון בבקשת ההסגרה לא נועד לבירור פרטי האישומים הפליליים המיוחסים למבוקש ההסגרה אלא שאלו עתידים לידון במשפט הפלילי במדינה המבוקשת במקרה שבקשת ההסגרה תתקבל.
האם מותר למבוקש הסגרה לעיין בחומרי החקירה שנאספו בעניינו על ידי הרשויות בישראל?
תקנות ההסגרה בסעיף 8 קובעות מבוקש ההסגרה או עורך דין פלילי המייצג אותו רשאי לעיין בכל חומר הראיות הנוגע לבקשת ההסגרה כשמתוך התקנה עולה כי נדרשים שני תנאים מצטברים כדי לאפשר למבוקש ההסגרה את הזכות בעיון בחומרי הראיות:
א. החומר “מצוי בידי העותר” כלומר החומר קיים בידיה של המדינה מגישת בקשת ההסגרה.
ב. החומר “נוגע לעתירה” כלומר, החומר רלוונטי לבקשת ההסגרה.
האם חומר הראיות המבוקש רלוונטי להתגוננות בפני בקשת ההסגרה
בבקשת הסגרה בניגוד למשפט פלילי הרי שחומר הראיות לא נועד כדי להכין את הגנתו של המבוקש מהאישומים כנגדו שכן אלו יתבררו בעתיד בהליך העיקרי במקרה ובקשת ההסגרה תתקבל.
חומר ראיות שיש בו כדי לשמש את מבוקש ההסגרה לצורך התגוננות מבקשת ההסגרה עצמה ואשר מקים זכות עיון בחומר החקירה הוא חומר ראיות שמוכיח התקיימות של סייג שבגינו אין להסגירו לפי סעיף 2ב לחוק ההסגרה או לחילופין לא נתמלאו תנאי סעיף 9(א) לחוק ההסגרה לצורך קבלת בקשת ההסגרה במלואה ואשר בה נדרשת רמת הוכחה בראיות שיש בהם כדי לבסס “אחיזה לאישום”.
גילוי חומרי חקירה בהליך הסגרה דומה לזה הנדרש בהתאם לחוק סדר הדין הפלילי כשבשאלת גילוי חומרי חקירה במסגרת בקשת הסגרה יש לערוך איזון בין זכותו של המבוקש להליך הסגרה הוגן לבין האינטרס הציבורי שטבוע בהתחייבויות הבינלאומיות של ישראל ואשר עלולות לחייב את הסגרת המבוקש בהתאם לשיתוף הפעולה בין המדינות.
מבוקש ההסגרה צריך להראות לבית המשפט שחומרי החקירה אותם הוא מבקש הם כאלו שיש בהם כדי לערער את התשתית שעליה מתבססת בקשת ההסגרה על חומרי הראיות שבתוכה.
“אחיזה לאישום” בבקשת הסגרה
כשבית המשפט מתבקש להכריע בשאלה העיקרית בבקשת ההסגרה, כלומר האם הבקשה עומדת בתנאים שבסעיף 9(א) לחוק ההסגרה הרי שבית המשפט לבדוק את בסיסה של התשתית הראייתית שצורפה לבקשת ההסגרה באופן לכאורי ולהכריע בשאלה האם הראיות מקימות ומבססות “אחיזה” לאישום שמיוחס למבוקש ההסגרה.

Our website implements the ARIA attributes (Accessible Rich Internet Applications) technique, alongside various different behavioral changes, to ensure blind users visiting with
screen-readers are able to read, comprehend, and enjoy the website’s functions. As soon as a user with a screen-reader enters your site, they immediately receive
a prompt to enter the Screen-Reader Profile so they can browse and operate your site effectively. Here’s how our website covers some of the most important screen-reader requirements,

Screen-reader optimization: we run a background process that learns the website’s components from top to bottom, to ensure ongoing compliance even when updating the website.

Additional UI, design, and readability adjustments
Font adjustments – users, can increase and decrease its size, change its family (type), adjust the spacing, alignment, line height, and more.
Color adjustments – users can select various color contrast profiles such as light, dark, inverted, and monochrome. Additionally, users can swap color schemes of titles, texts, and backgrounds, with over 7 different coloring options.
Animations – epileptic users can stop all running animations with the click of a button. Animations controlled by the interface include videos, GIFs, and CSS flashing transitions.
Content highlighting – users can choose to emphasize important elements such as links and titles. They can also choose to highlight focused or hovered elements only.
Audio muting – users with hearing devices may experience headaches or other issues due to automatic audio playing. This option lets users mute the entire website instantly.
Cognitive disorders – we utilize a search engine that is linked to Wikipedia and Wiktionary, allowing people with cognitive disorders to decipher meanings of phrases, initials, slang, and others.
Additional functions – we provide users the option to change cursor color and size, use a printing mode, enable a virtual keyboard, and many other functions.
Browser and assistive technology compatibility
We aim to support the widest array of browsers and assistive technologies as possible, so our users can choose the best fitting tools for them, with as few limitations as possible.
